ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for shop No.28 of Nagamallakunta village, Bethamcherla Mandal, Kurnool District. While so, the Tahsildar, Bethamcherla Mandal inspected the shop of the petitioner and found some irregularities. Based on the same, he submitted a report on 3.3.2015 to the third respondent, who by order dated 19.05.2015 suspended the authorization of the petitioner pending enquiry. Against the said order of suspension, the petitioner preferred an

appeal to the second respondent along with stay application on 16.6.2015. When no orders have been passed on the stay application filed along with the appeal, the petitioner filed the present Writ Petition.

Inasmuch as the petitioner has already preferred an appeal before the second respondent against the order of suspension of authorization dated 19.5.2015, this Court is not inclined to go into the merits or otherwise of the subject matter. The petitioner is given fifteen days' time to submit his explanation to third respondent. On receipt of the explanation from the petitioner, the third respondent is directed to complete the enquiry and pass final order with thirty days thereafter after giving due opportunity to the petitioner and in accordance with law.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
