THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4864 OF 2017 O R D E R :

The case of the petitioner is that he is the son of late Sri T. Ananda Chetti, who was displaced on account of the developments that have taken place on Tirumala Hills. He seeks a direction to the 2nd respondent Tirumala Tirupati Devasthanams to allot a residential house and shops at Tirumala, pursuant to the policy decision taken in G.O.Ms.

528, Revenue (Endowments.III) Department, dated 31.08.2002 and G.O.Ms.No. 856 Revenue (Endowments.III) Department, dated 05.08.2003. Learned counsel for the petitioner submits that some of the displaced persons have already been allotted alternative shops/space for carrying on their business and eaking out livelihood and in this context, he submits that the petitioner had made several representations, latest being the one dated 19.12.2016. Hence, the learned counsel seeks a direction to the respondents to consider the representation made by the petitioner and extend the facility, as was done to the other similarly-situated persons.

Learned Standing Counsel appearing for the TTD submits that the issue relating to the displacement of the petitioner was of the year 1988 and much time has elapsed. He further submits that considering the observations made by the Courts that the land being scarce, the so-called rehabilitation scheme in the name of the displaced persons cannot be in eternity, the TTD has adopted the policy of not granting any alternative. In those circumstances, the learned Standing Counsel resisted the Writ Petition.

Having considered the respective submissions, without expressing any opinion, the Writ Petition can be disposed of with a direction to the respondent authorities to consider the representation of the petitioner, subject to the feasibility and as per the policy existing as of date, within three months from the date of receipt of a copy of this order. Ordered accordingly. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
