ORDER
This writ petition is filed seeking the following relief: "to issue a writ, order or direction declaring the action of respondents in not sanctioning Special Grade increments for 18 years and 24 years in the cadre of Lasker as illegal, arbitrary, unjust and unreasonable and contrary to principles of natural justice and consequently direct the respondents to sanction and release 18 years and 24 years Special Grade increments in the cadre of Laskar with all consequential benefits such as pension, medical bills etc and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case to meet the ends of justice."
Heard Sri M.Ratna Reddy, learned counsel appearing for the petitioners and learned Government Pleader for Services-II appearing for the respondents.
It is the case of the petitioners that initially, they were appointed as NMRs during the year 1983-84 and they are discharging their duties to the best satisfaction of their superiors. Subsequently, they were promoted to the post of Lasker in the year 1997. While so, when the respondents are not considering their cases for regularization of their services in terms of G.O.M.S.No.212, dated 22.4.1994, the petitioners filed a writ petition before this Court and the said writ petition is still pending.
Learned counsel appearing for the petitioners submits that on completion of 12 years of service, the respondents have granted 12 years special grade increment to the petitioners; that though the petitioners have submitted a representation dated 6.11.2018 to the respondents, so far, the respondents neither passed any orders on the said representation nor extended 18 years special grade increment to them; and that appropriate orders be passed directing the respondents to consider the cases of the petitioners for grant of 18 years special grade increment.
Learned Government Pleader appearing for the respondents submits that the services of the petitioners are yet to be regularized and hence, the question of considering their cases for grant of special grade increment on completion of 18 years of service does not arise.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that the petitioners have submitted the representation to the respondents on 06.11.2018 seeking consideration of their cases for grant of special grade increment on completion of 18 years of service. But, so far, no orders have been passed thereon.
Accordingly, the writ petition is disposed of directing the respondents to consider the representation of the petitioners dated 6.11.2018 and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
