HON'BLE DR. JUSTICE B. SIVA SANKARA RAO SECOND APPEAL No.216 of 2018 JUDGMENT:

Heard learned counsel for the appellant and learned counsel for the respondent and on hearing and perusal of the material on record, practically there is no any substantial questions of law involved.

Hence, the Second Appeal is disposed of before admission confirming the judgments of the trial Court and lower appellate Court by granting time till end of December 2018 subject to payment of use and occupation charges as usual and subject to giving of undertaking within 15 days from the date of receipt of this order of not to cause any damage, not to sub let and to pay all arrears after adjustment of the advance amount by June 2018. It is made clear that after 31.12.2018, the appellant/defendant cannot continue in the property nor entitled to any extension and after adjustment of the advance amount if at all there is anything due he has to pay and without clearing all arrears by June 2018 he cannot continue.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
