THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.33023 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the first respondent in not disposing the LTRP No.1/2013 filed by the petitioner for eviction of the respondents 3 to 13 in respect of the land situated in Sy.No.3/1 to an extent of Ac.1-60 Cents situated at Nellipudi Village of Gangqvaram Mandal of East Godavari is arbitrary, illegal and violative of Article 14,21 and 300(A) of the Constitution of India." Heard Sri K. Sarath, learned counsel for the petitioner and learned Government Pleader for Social Welfare for respondents, apart from perusing the material available before this Court.

As evident from the pleadings in the affidavit filed in support of the writ petition the only grievance of the petitioner is non-disposal of L.T.R.P.No.1 of 2013 pending on the file of the Spl. Deputy Collector (Tribal Welfare), Rampachodavaram, East Godavari District - 1st respondent herein. It is submitted by the learned counsel for the petitioner herein that despite lapse of considerable length of time no orders have been passed so far by the 1st respondent herein on the said Land Transfer Regulation Case. It is further submitted that in view of the said inaction the petitioner herein is suffering undue hardship and irreparable loss.

Taking into account the nature of controversy, this Court is of the considered opinion that the ends of justice would be met if a direction is given to the 1st respondent herein to pass appropriate orders on the said L.T.R.P.No.1 of 2013 by fixing some timeframe.

For the aforesaid reasons, the writ petition stands disposed of, directing the 1st

respondent herein to pass appropriate orders on L.T.R.P.No.1 of 2013, in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order, after giving notice and opportunity of being heard to all the stakeholders.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
