ORDER

This writ petition is filed seeking the following relief: "....to issue an appropriate writ, order or direction preferably one in the nature of Writ of Mandamus, declaring the action of the respondents herein in not absorbing the petitioner into service as a lecturer in Zoology in the 2nd respondent's college on contract basis as usual as illegal, arbitrary and contrary to the principles of natural justice and consequently direct the respondents herein to permit the petitioner to work as Lecturer in Zoology in the 2nd respondent's College on contract basis."

Learned counsel appearing for the petitioner contends that though the petitioner is working as part-time lecturer in Zoology in the respondent-University since 12-09-1997 and is qualified and eligible to be appointed as Lecturer on regular basis, the respondents are not considering his case for regular appointment.

While admitting the writ petition on 24.07.2003, this Court in WPMP No.18799 of 2003 directed the respondents to continue the petitioner as long as the work exists and till regular appointments are made. In pursuance of the same, the petitioner was continued as part-time lecturer. Learned Standing Counsel appearing for the respondents contends that contract lecturers are not entitled

for regular appointment and since the petitioner was not selected by the duly constituted selection committee, he is not entitled for the relief as sought for by him. Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that ends of justice would be met if a direction is given to the respondents to consider the case of the petitioner for regular appointment.

Accordingly, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for regular appointment, if he is discharging his duties as on today, in accordance with the rules and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
