HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.Nos.6554, 6591, 6595 and 6822 of 2009 COMMON ORDER:

Since the subject matter of these writ petitions is one and same, they are heard together and disposed of by this Common order.

These writ petitions are filed for a writ of mandamus, declaring the auction notification in Rc.No.C3/102/2009-1 dated 19.03.2009 issued by the respondent for auctioning lease hold rights of the land which is in occupation of the petitioners. In all these writ petitions, this Court granted interim orders. The impugned tender notification is issued for grant of lease hold rights for a period of 3 years. But by efflux of time, the period of 3 years has expired. As such, quashing of auction notification at this stage does not serve any purpose. As far as interference with the possession of the petitioners is concerned, the respondent states that the subject land belongs to the temple whereas the petitioners dispute the same.

Since, it is admitted that the petitioners are in possession of the subject land, these writ petitions are disposed of with a direction to the respondents not to dispossess the petitioners without following due process of law. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
