HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1987 OF 2015 O R D E R :

This writ petition is filed seeking a Writ of Mandamus declaring the action of the respondents 2 and 3 in issuing notice dated 27.01.2015, for cancellation of mutation granted in favour of petitioner in respect of H.No.1-2-31, situated in Taka Street, Jagtial, Karimnagar District, as illegal and arbitrary. The case of the petitioner is that the 3rd respondent issued notice dated 27.01.2015 directing the petitioner to produce registered documents and link documents basing on which his name was mutated in the revenue records in respect of H.No.1-231. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that if there is any dispute regarding mutation, the authorities would have directed the parties to approach the Civil Court instead they issued impugned notice, asking the petitioner to produce the documents. He also submits that the 4th respondent would have filed a civil suit, if he has any objection regarding mutation. On the other hand, Sri D. Bhaskar Reddy, learned Standing counsel for respondents 2 and 3 submits that the notice was issued to the petitioner asking him only to produce the registered documents, basing on which the mutation was done.

In view of the above facts and circumstances, since it is stated that the notice was issued to the petitioner only to produce the documents on which the mutation was done, the petitioner has to produce the same, and the same shall be considered by the Commissioner.

have to approach the Civil Court only, since the municipal authorities have no power to decide the questions of title. Accordingly, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
