SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1537 OF 2018 ORDER:

This Criminal Petition is filed, seeking for relaxation of the condition imposed by the Principal Sessions Judge, Khammam in Crl.MP.No.28 of 2018 in Crime No.292 of 2017 on the file of the Station House Officer, Raghunadhapalem Police Station, Khammam District.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record.

The conditions imposed by the Principal Sessions Judge, Khammam, are as follows:

(i) The petitioner shall be enlarged on bail on furnishing personal bond for Rs.1,00,000/- (Rupees one lakh only) with one surety to the satisfaction of this court to release him on bail for a period of fifteen days from the date of release.

(ii) After release, the petitioner shall take expeditious steps for disposal of thirteen properties referred in the report submitted by the investigating officer and such a sale shall be made under the supervision of Sri K.Ramesh, Government Pleader of this Court.

(iii) The amount fetched shall be deposited in this court in order to proportionately distribute among the victims.

(iv) On completion of period of 15 days, the petitioner shall surrender before this Court. Counsel for the petitioner submits that the time granted to dispose of the properties i.e. within 15 days is very short and after expiry of 15 days, due to failure to dispose of the properties, the

petitioner was again arrested and now he seeks to enlarge the petitioner on bail with the conditions being kept in tact. Hence, considering the fact that it would be difficult for the petitioner to dispose of the properties within a short period of 15 days, three (3) months time, as sought by the counsel for the petitioner, is granted. The rest of the conditions remain in tact. Further, the petitioner shall be released on interim bail on his executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the III Additional Judicial First Class Magistrate, Khammam.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. ______________ (T.RAJANI, J) 16th February 2018 RRB
