HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19802 OF 2016 ORDER:

The case of the petitioner is that she was allotted land of an extent of Ac.304 cents in Sy.No.301/2 and Ac.1-00 cents in Sy.No.305/1 for a total extent of Ac.4-04 cents situated at Vangali Village, Sabbavaram Mandal, Visakhapatnam District vide D-Form patta in Dr.No.21/83A3 dated 23.11.1983 issued by the 4th respondent. The petitioner also availed loan from Anakapalli Cooperative Central Bank on the strength of Mortgage of aforesaid property. While so, the respondents are trying to acquire the petitioner's land for the purpose of Educational Hub without issuing any notice to the petitioner as per the Provisions of Act No.30 of 2013 and are disbursing the compensation amount to the third parties other than the original patta holders without following procedure as contemplated under A.P.Assigned Lands (Prohibition of Transfers) Act, 1977.

With regard to the same, petitioner made a representation dated 22.08.2015 to the 4th respondent requesting him not to disburse any compensation amount in respect of the subject land. As no action has been taken, the present writ petition is filed. Heard both sides.

In view of the above facts and circumstances, the respondents shall consider the representation of the petitioner dated 22.08.2015 before disbursement of the compensation amount in respect of the subject land. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
