HON'BLE THE CHI EF JUSTI CE SRI THOTTATHI L B. RADHAKRI SHNAN AND HON'BLE SRI JUSTI CE RAMESH RANGANATHAN CONTEMPT CASE No.364 of 2018 ORDER: (per the Hon'ble Sri Justice Ramesh Ranganathan) This Contempt Case is filed alleging non-compliance of the order passed in W.P.No.21141 of 2017 dated 22.08.2017, whereby the respondents were required to consider and take an appropriate decision, regarding enhancement of the age of superannuation of its employees from 58 years to 60 years, within three months from the date of the order.

As the order was passed by this Court on 22.08.2017, the stipulated three month period expired on 22.11.2017. However, the Board of Directors considered and rejected the request of the petitioners, for enhancement of the age of superannuation from 58 years to 60 years, in its meeting held on 19.06.2018. While there is, no doubt, a delay of eight months in complying with the order passed by this Court, an affidavit is filed by the Vice-Chairman and Managing Director of the APSRTC explaining the reasons for the delay in compliance. He has also tendered his unconditional apology for the delay.

In view of the unconditional apology tendered by the 2nd respondent, we see no reason to take any future action against any of the respondents under the Contempt of Courts Act for belated

compliance of the order passed in W.P.No.21141 of 2017 dated 22.08.2017.

The Contempt Case is, accordingly, closed.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
