This Company Petition is filed seeking Winding-Up of 1st respondentCompany (M/s Sanghi Polyester Ltd.) on the ground that the company failed to discharge its liability to the petitioner to the tune of Rs.17,12,369/-. The Company Petition was admitted on 30.06.2014, however, the publication of advertisement was deferred, as yet another Company Petition viz., C.P.No.42 of 2010 (against M/s Sanghi Polyester Ltd, the 1st respondent herein) was admitted and the publication of advertisement was carried out in the said C.P.No.42 of 2010.

Now, it is brought to the notice of this Court that C.P.No.42 of 2010 came to be allowed by this Court by order dated 16.09.2014 by ordering the 1st respondent-Company to be Wound Up, and the said order became final. In the light of the same, the present Company Petition is closed by giving liberty to the petitioner to file their claim with the Official Liquidator, in due course.
