THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2499 OF 2015 ORDER:
The petitioner filed the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the judgment, dated 01.07.2015 passed in EC Appeal No.20 of 2013 by the Sessions Judge, Krishna Division, Machilipanam. Heard and perused the material available on record. The petitioner is a Rice Miller. The District Collector, Krishna, has passed an order confiscating 20% of the seized stock vide proceedings, dated 28.12.2012 on the ground that the petitioner has contravened certain control orders. Against the said order, the petitioner preferred E.C. Appeal No.20 of 2013 before the Sessions Judge, Krishna Division, Machilipatnam. The learned Sessions Judge, while confirming the order passed by the District Collector, reduced the confiscation of the seized stock from 20% to 10%. Aggrieved by the said order, the present revision is filed.
After hearing the arguments of the learned counsel for both sides and after perusing the material available on record, this Court is not inclined to interfere with the concurrent findings of the Courts below and hence, the revision is liable to be dismissed.
Accordingly, the Criminal Revision Case is dismissed. Miscellaneous petitions filed in this revision, if any, shall stand closed. ______________ RAJA ELANGO, J October 29, 2015 KTL
