This writ petition is filed seeking Mandamus declaring the inaction of respondent Nos.4 to 6 in considering the application of the petitioner vide Mee Seva Receipt No.TTDER022000462640, dt,17.01.2020 and TTDER021900366695 dt.11.01.2019 for conducting survey and fixing the boundaries in respect of the lands in Sy.No.424/e1 to an extent of Ac.1-17 gts situated at Tettelapadu Village, Tirumalayapalem Mandal, Khammam District, as illegal, arbitrary, contrary to the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923 and unconstitutional and consequently direct respondent No.4 to forthwith conduct survey and fix boundaries in respect of the above lands.
Learned counsel for the petitioner submits that the issue involved in this writ petition is squarely covered by the common order dt.28.04.2016 in W.P.No.4811 of 2011 and batch passed by this Court and the same is not disputed by the learned Government Pleader for Revenue.
Accordingly, this writ petition is disposed of in terms of the common order dt.28.04.2016 in W.P.No.4811 of 2011 and batch directing the respondent authorities to consider the
ARR,J W.P.No.5170 of 2020 application dt.17.01.2020 of the petitioner for survey and demarcation of the subject land after receiving necessary charges, keeping in view the Circulars vide Rc.No.N1/1408/07, dt.13.07.2007, Rc.No.N1/6543/99, dt.25.07.2001 and Circular vide Rc.No.N2/1741/2010, dt.18.05.2010 and also in terms of the judgment in W.A.No.618 of 2013 and also keeping in view the provisions of Sections 89, 89-A and 92 of the Andhra Pradesh (Telangana Area) Land Revenue Act, 1317 Fasli and take necessary action and communicate the decision to the parties. It is open for the petitioner to prefer an appeal against the said order, if he is aggrieved in terms of Circulars referred to above. No order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
