HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.20987 OF 2003 ORDER:

When the matter is taken up for hearing, counsel for the petitioner has informed the Court that the petitioner has retired from service on attaining the age of superannuation and, therefore, the cause in the writ petition may not survive as the petitioner was challenging the disciplinary proceedings said to have been initiated against him by the respondents and this Court vide order dated 26.09.2003 granted interim stay of all further proceedings pursuant to the disciplinary proceedings initiated against the petitioner and the said interim order is continued till today.

[ In view of the above submissions and also considering the facts that there was interim stay of the disciplinary proceedings all through the pendency of the writ petition and the petitioner has retired from service on attaining the age of superannuation, this Court is of the considered view that the cause in the writ petition does not survive. Further, the respondents have not filed vacate stay petition. Accordingly, the writ petition is closed. No order as to costs.
