Heard learned counsel for the petitioner and learned Government Pleader for Revenue. No representation on behalf of the unofficial respondent. Since the writ petition is being disposed of without going into merits of the case, it may not be necessary to issue notice to the unofficial respondent. 2.

The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondent-authorities in not removing the encroachment made by respondent No. 6 on road margin abutting/between petitioner's land admeasuring Ac.1.20 cents in Survey No.371/2 of Korangi Village of East Godavari District and the bye-pass road, as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioner mainly seeks a direction to the Tahsildar to act on the letter dated 20.02.2016, issued by the Assistant Executive Engineer (R&B), (R&B) NH Section, Kakinada to the Tahsildar, Tallarevu Mandal, Tallarevu, seeking for appropriate action with regard to unauthorized water servicing shed constructed at Tallarevu village limits in Tallarevu Mandal. 4.

Learned Government Pleader would submit that if no action has been taken on the said representation, suitable

direction may be given to the Tahsildar, to act in accordance with law.

Having regard to the above, the writ petition is disposed of directing the Tahsildar-respondent No. 4 to act in accordance with law on the letter dated 20.02.2016, as early as possible, preferably within a period of four to six weeks, after hearing the petitioner and also the unofficial respondent. 6.
