THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13251 of 2017 ORDER:

This Writ Petition is filed challenging registration of Crime No.25 of 2017 on the complaint lodged by the third respondent alleging involvement of the petitioners in attacking the complainant and his wife. It was also alleged in the complaint that while attacking the third respondent, they were also abused in the name of caste.

A reading of the complaint discloses a prima facie case for registration of the crime, and in view of the same, this Court is not inclined to entertain the present Writ Petition. However, the Writ Petition is disposed of directing the second respondent to conduct the investigation in accordance with law, including compliance with Section 41-A of the Code of Criminal Procedure. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
