J.Shanthamma, v. State Of Andhra Pradesh,
HONOURABLE SMT JUSTICE T. RAJANI CRIMINAL PETITION No.598 of 2017 ORDER:
1.
The learned Public Prosecutor takes notice. Heard both sides. Both the Counsel agreed for this matter to be disposed of at the stage of admission.
2.
This petition is filed seeking for quashing of the proceedings in C.C.No.78 of 2016 on the file of the Judicial First Class Magistrate, Puttur, Chittoor District for the offence alleged against the petitioners-accused Nos.2 to 7 under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.
3.
It is brought to the notice that no charges are yet framed. Hence, the petitioners can file a discharge petition before the Court below and obtain necessary orders. However, considering the plea of the learned Counsel for the petitioners that the petitioners are residing in three States, their appearance is dispensed with till the discharge petition is disposed of and the Court below shall not insist on the appearance of the petitioners unless their presence is necessary for the proceedings of the Court. 4.
Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. _________________ JUSTICE T. RAJANI Date: 9th October, 2017 Nn
