ORDER

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused No.1 in Crime No.15 of 2026 before the Dundigal Police Station, Cyberabad, registered for the offence punishable under Sections 338, 336(3), 318(4), 329(3), 324(4) r/w 3(5) of BNS.

The brief facts of the case are that prior to 06.01.2026 at about 16:00 hours, the complainant Mr. Abhishek Arun Ahale lodged a report stating that his father had purchased land admeasuring guntas in Sy.No.227/B, Gagilapur Village, Dundigal Mandal, Medchal District, through a registered sale deed in 1985, and that certain accused persons, taking advantage of his father's long absence abroad, fabricated documents, executed multiple sale deeds, formed a layout, and raised constructions on the said land without lawful authority, thereby committing offences of forgery, cheating, criminal conspiracy, and trespass.

Heard Sri K.Abhinav Mahender Reddy, learned counsel for petitioner, and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that there are no specific overt acts attributed against the petitioner under the alleged provisions, and the FIR was

registered mechanically without proper enquiry.

He contended that the petitioner is the absolute owner of the property, having inherited it from his late father who developed the land into a residential layout decades ago, and has been selling plots with valid title. He lamented that the dispute is purely civil in nature involving questions of title and possession, but has been converted into a criminal case to harass the petitioner. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners, and contended that that the complaint discloses specific allegations of fabrication of documents, illegal occupation, and construction on the disputed land, which are serious in nature. He contended that the investigation is at a preliminary stage, and custodial interrogation of the petitioner may be necessary to ascertain the extent of forgery, conspiracy, and land

grabbing. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions and material on record, it is noted that the investigation in the matter is based on documentary evidence and there is no specific requirement of custodial interrogation.

Therefore, considering the circumstances of the case in entirety, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Dundigal Police Station, Cyberabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2)

of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
