THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1793 OF 2018 ORDER:
This petition is filed by the petitioner-A1 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.320 of 2017 on the file of the Station House Officer, Ongole I Town Police Station, Ongole, which was registered for the offences punishable under Sections 406 and 420 IPC.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that a direction may be given to the Station House Officer to invoke Section 41-A Cr.P.C.

On the other hand, learned Assistant Public Prosecutor would submit that the petitioner is on different pedestal. This Court was pleased to direct the S.H.O. to apply provisions of Section 41-A Cr.P.C. in respect of A2, as the allegations made against A2 are different. 5.
As per the material placed on record, an amount of Rs.31,00,000/- said to have been mis-appropriated by the petitioner-A1. The matter requires examination. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the Criminal Petition. 6.
Therefore, the Criminal Petition is dismissed as withdrawn. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
