THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14270 of 2015 ORDER:
The relief sought for in this writ petition is to declare the action of the 3rd respondent in calling the petitioner to the police station and threatening to implicate him in Crime No.53 of 2015 though he is no way concerned with the same, as illegal and arbitrary Learned counsel for the petitioner contended that without figuring the petitioner as an accused in Crime No.53 of 2015, he was being called to the police station and being threatened.
On the other hand, the learned Assistant Government Pleader for Home has stated that though his name was not figured as an accused in the F.I.R., during the course of investigation, later it came to light that he was also involved in the said crime and hence he was figured as A.2. Though the case was initially registered under Section 337 I.P.C., later, basing on the material collected during the course of investigation, it was altered to Sections 120-B, 307 r/w 34 I.P.C. In view of the fact that the petitioner is A.2 in Crime No.53 of 2015, the 3rd respondent has got every right to summon him to the police station in accordance with law.
There are no grounds in the writ petition and it is, accordingly, dismissed.
