HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE Writ Petition No. 25448 OF 2010 ORDER:

Heard learned counsel for the petitioner. None appears for the respondents.

The petitioner, in the present writ petition, makes the following prayer:

"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the Proceedings of the 2nd Respondent in Rc.C1/1084/2010, dated 4.10.2010 as illegal, null and void and pass such other appropriate orders as are deemed fit and proper in the interest of justice."

By the impugned proceedings, the petitioner's licence to run cinema theatre was suspended.

This Court, while issuing Rule on 3.11.2010, had granted interim suspension as prayed for. By virtue thereof, Mr. K. Durga Prasad, learned counsel for the petitioner submits that the petitioner has been running the theatre without any interruption. That being so, I am satisfied that this writ petition can be conveniently disposed of by the following order:

"1. The impugned proceedings dated 4.10.2010 is set aside. The writ petition is disposed of with liberty to the respondents to initiate fresh proceedings against the petitioner. If for any reason, it is found that his licence is liable to be suspended or cancelled, it is needless to mention that for initiating any such proceedings and, passing any order, they shall follow the principles of natural justice." With these observations, the writ petition is disposed of. Consequently, pending miscellaneous applications shall also stand closed. No costs.
