THE HONOURABLE SMT JUSTICE P.MADHAVI DEVI W.P.No.7668 OF 2022 ORDER:

This Writ Petition has been filed by the petitioner seeking a 'Writ of Mandamus' declaring the action of the Respondents 2 to 11 in proposing to lay the road in petitioner's land in Sy.No.540 & 562 situated at Eliminedu Village, Ibrahimpatnam Mandal, Ranga Reddy District, Telangana State, without following due process of law, as illegal and arbitrary.

The petitioner apprehending laying of road in his lands in Sy.No.540 & 562 situated at Eliminedu Village, Ibrahimpatnam Mandal, Ranga Reddy District, had earlier filed Writ Petition No. 8193 of 2015 and vide orders dated 26.03.2015, a direction was given not to interfere with the lands of the petitioner in Sy.Nos.540 & 562 situated at Eliminedu Village, Ibrahimpatnam Mandal, Ranga Reddy District. Thereafter, apprehending laying of road by respondent No.1, the petitioner has again filed this Writ Petition.

The learned Government pleader for Roads and Buildings appeared and submits that there is no proposal for the respondent No.1 to lay any road in the lands of the petitioner. As seen from the array of respondents in W.P.No.8193 of 2015,

all other respondents are already parties in the said Writ Petition.

Therefore, there is no cause of action to file this Writ Petition before this Court when already there is a protection from this Court by virtue of interim orders dated 26.03.2015 passed in W.P.No.8193 of 2015.

The Writ Petition is accordingly dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
