THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.19126 of 2017 ORDER :

This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: " to issue order direction more particularly one in the nature of writ of MANDAMUS declare the action of the respondents in not taking action on the enquiry report submitted by the 3rd respondent against 4th respondent who obtained fake ST Caste Certificate and continue as a MPTC as illegal arbitrary and contrary to the provisions of AP(SC,ST&BC) Regulation of Issue of Community Certificate Act, 1993 and consequentially direct the 2nd & 3rd respondents not to conduct any MPP elections of Jeelugumilli, West Godavari District and pass such other order or orders may deem fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner and also the learned Government Pleaders for Panchayat Raj and Revenue for respondents 1 to 3, before ordering notice to the 4th respondent and perused the prayer and affidavit filed in support of the writ petition along with material. The proceedings dated 03.06.2016 of the 2nd respondent addressed to the 3rd respondent shows that detailed enquiry has to be conducted and a report has to be submitted by the later. It is the grievance of the petitioner that despite the same, there is no action taken by the 3rd respondent and no report has been received so far.

Having regard to the above, the respondents-Authorities are directed to see that enquiry, if not completed, be completed at any cost within four weeks from the date of receipt of copy of this order and the 2nd respondent shall take necessary action on the representation, if any made by the petitioner, in accordance with law, within four weeks from the date of receipt of copy of this order, if necessary after hearing the petitioner and communicate the same to her. With the above directions, this Writ Petition is disposed of at the stage of admission. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
