HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.5088 of 2019 ORDER:

This Writ Petition is filed seeking Writ of Mandamus declaring the action of the 2nd respondent in issuing suspension orders vide proceedings dated 14-05-2018 as arbitrary, illegal, unconstitutional, violative of principles of natural justice and also violative of Articles 14, 15, 16 and 19 of the Constitution of India and sought a consequential direction to suspend the impugned proceedings dated 14-05-2018 passed by the 2nd respondent. 2.

Heard Sri D.Srinivas Reddy, learned counsel for the petitioner and the learned Government Pleader for Services-II appearing for respondents.

It has been contended by the petitioner that he is working as Village Revenue Officer and while he was discharging duties, 2nd respondent has suspended him on 14-05-2018 pending disciplinary action.

The grievance of the petitioner is that the respondents have not issued any charge sheet nor proceedings and without initiating disciplinary proceedings, placed him under suspension. He also made a representation on 01-09-2018 to permit him to join into duties, but the respondents have not reviewed the suspension orders even after the completion of six months from the date of his

Learned counsel for the petitioner contended that appropriate orders may be passed in the Writ Petition directing the respondents to review suspension orders passed against the petitioner strictly in terms of G.O.Ms.No.86 dated 08-03-1994. 6.

Learned Government Pleader for Services-II appearing for the respondents submits that the case of the petitioner would be considered and the petitioner's suspension orders would be reviewed strictly in terms of G.O.Ms.No.86 dated 08-03-1994 and appropriate orders would be passed.

This Court, having considered the rival submissions made by the parties, of the considered view that the Writ Petition can be disposed of directing the respondents to review the suspension of the petitioner in terms of G.O.Ms.No.86 dated 08-03-1994 and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. 8.

With these observations, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
