This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of bail in Crime No.440 of 2018 of Narsingi Police Station, Cyberabad Commissionerate, registered for the offence punishable under Section 14 of Foreigners Act, 1946.

Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the respondent/ State and perused the record.

As seen from the material placed on record, the petitioner/ accused is overstaying in India without having any valid passport and VISA. It is brought to the notice of this Court that already prosecution witnesses were examined and the subject case was posted for hearing. Once the petitioner is set at liberty, it is difficult to trace her to conclude the trial of the case. Under these circumstances, this Court is declined to consider this bail petition. 4.

Hence, the Criminal Petition is dismissed.
