Petitioners /Accused AND The State of Andhra Pradesh, rep. by it's Public Prosecutor, High Court of Judicature at Hyderabad for the State of Telangana and the State of Andhra Pradesh. .....Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition filed herein, the High Court may be pleased to direct the Station House Officer, Danchali Police Station, Guntur District to release the petitioners on bail in the event of their arrest puusuant to Crime No.55/2015 of Dachepalli Police Station Guntur District.

The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri K.Suresh Reddy, Advocate for the Petitioners, and of Public Prosecutor (AP) for the Respondent, the Court made the following.

ORDER

This Criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/accused seeking grant of anticipatory bail in Crime No.55 of

2015 on the file of the Dachepalli Police Station, Guntur District, registered for the offences under Section 323, 324,427, 448, 307, 147,148 read with Section 149 IPC. Heard and perused the record.

Learned counsel for the petitioners submits that the petitioners have not committed any offence and they are law abiding citizens, and they are ready to cooperate with the investigating agency. He further submits that the injured were treated in the hospital and were discharged. Hence, he prays this Court to grant anticipatory bail to the petitioners/accused. Considering the facts and circumstance and the nature of allegations and also as the petitioners are not having any previous cases, this Court is inclined to grant anticipatory bail to the petitioners herein.

The petitioners/accused are directed to surrender before the Magistrate concerned on or before 21.01.2016 and on such surrender, they shall be enlarged on bail on the same day on each of them executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum each to the satisfaction of the Magistrate concerned. Further, the petitioners/accused are directed to report before the Station House Officer, concerned daily between 10.00 a.m. and 5.00 p.m. for a period of ten days.
