THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No 4282 of 2018 ORDER:
When the matter is taken up, written instructions furnished by the Sub Inspector of Police, Women Police Station, Begumpet, Hyderabad dated 09.02.2018 are placed on record by the Government Pleader . The instructions read as under: Smt. Farhanaaz (wife of the petitioner herein) has approached the police of Women Police Station, Begumpet and lodged a complaint on 03.02.2018 against her husband Mr.Sajid and her perents-inlaw as they subjected her mentally and physically and keeping their minor children with them and they separated with her children and threatening her with dire consequences if she asks children kill her and hence requested to take necessary action as per law. Upon receipt of the said complaint, an entry was made into the Station General Dairy, after enquiry into the petition necessary action will be taken since it is a family dispute. Counselling was held. Though the petitioner attended for counseling, did not cooperate with counseling authorities.
Hence, basing on the above complaint, a case in Cr.No. 25/2018 under Sections 498 A IPC and Secs. 4 and 6 of Dowry Prohibition Act dated 08.02.2018 was registered on the file of Women Police Station, Begumpet against the petitioner herein and taken up the investigation into the case.
The FIR was registered on 08.02.2018. The investigation is at the initial stage. Necessary steps will be taken against the accused in the FIR including the petitioner/A1, depending on the evidence adduced during the course of investigation into the case. On coming to know the lodging of the complaint with the police, to prevent the police from taking any action in the event of registration of any case against him, the petitioner on mere apprehension, rushed to this Hon'ble Court and filed the present writ petition with false and frivolous allegations.
I humbly submit that this respondent till date, did not summon the petitioner, I submit that the petitioner is required in connection with the above case. Basing
on the investigation, appropriate steps will be taken against him. All the allegations made in the affidavit are false, exaggerated, concocted and hence denied. It is submitted that the respondents Nos.4 to 7 called him to the Women Police Station, Begumpet by sending a constable to his home on 05.02.2018 at the instance of the 8th respondent then, he explained the illegal acts committed by the respondent No.8 and also shown the photographs of her while she was in the company of her paramour, then the respondents 4 to 7 realized and found that he has not committed any mistake and the respondents No..8 approached them falsely and sent him to his house is absolutely false, baseless and hence denied.
It is submitted that the allegations of the petitioner that the respondent Nos. 4 to 7 again calling him since 06.02.2018 and threatening him to hand over the minor children i.e., the daughter and son to the 8th respondent otherwise he has to face dire consequences is utterly false and hence denied. All the allegations made in the affidavit are false, concocted, exaggerated and invented for the purpose of filing the writ petition and hence the same are denied.

on noticing the same, request is made by the learned counsel for the petitioner to place on record the above instructions and dispose of the writ petition.

Accordingly, the Writ Petition stands disposed of by placing on record the above written instructions furnished by the Sub Inspector of Police, Women Police Station, Begumpet, Hyderabad, dated 09.02.2018.

As a sequel there to, miscellaneous application, pending if any, shall stand closed.
