HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13576 OF 2017 ORDER:

This writ petition is filed declaring the order issued by the 2nd respondent under ROR Revision Petition No.86/2015 dated 28.01.2017, as illegal and arbitrary and to set aside the same. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Though learned counsel for the petitioner submits that the petitioner's father has purchased the subject property through registered sale deed, writ affidavit does not show the particulars of the same. The affidavit in support of the writ petition is vague. Even the Joint Collector dismissed the Revision on the ground that the petitioner has not produced any document showing that his father has purchased the subject land from its original pattadar Sri Sameneni Venkaiah.

Joint Collector also found that the respondents are in physical possession of the subject land for a long time and the petitioner is not possession. In view of the above, I do not see any reason to entertain the writ petition. Moreso, this Court cannot go into the disputed questions of fact and decide the title of the parties. Accordingly, the writ petition is dismissed. However, it is open for the petitioner to avail alternate remedy available under Section 8(2) of Andhra Pradesh Rights in Lands and Pattdar Passbooks Act, 1971. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 18.04.2017 dv
