THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.28423 OF 2007 ORDER:

This writ petition is filed, seeking to declare the action of the respondents in not taking any action on the representation of the petitioners dated 20.09.2007 and the legal notice dated 29.11.2007 issued on behalf of the petitioners with regard to allotment of house site pattas in Sy.Nos.180, 181 and 185 of Rayavaram Village and Mandal, East Godavari District to the persons who are in illegal occupation and in contravention of A.P.

Assigned Lands (Prohibition of Transfers) Act, 1977 as illegal, arbitrary and unjust and consequently direct the respondents to take appropriate action as per law.

Smt.Krishnaveni, learned Assistant Government Pleader for Revenue submits that the house site patta was granted in the name of Smt.Swaroopa Rani, wife of the first petitioner and also in favour of the second petitioner and she has also drawn attention of this Court to para 5 of the counter affidavit. In view of the same, nothing survives for adjudication in this writ petition. 3.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
