THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION NO.98 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) It appears, despite the representation made, no action has been taken is the allegation of the petitioners.

Learned counsel for the unofficial respondents submits that the writ petition is liable to be dismissed on the ground of suppression of material fact. We feel at this stage that if they file counter on the question of suppression of fact, it would be of no use. Therefore, we dispose of the writ petition directing the Principal Secretary, Revenue Department, the 2nd respondent, to look into the complaint made by the petitioners, and while doing so, a notice has to be issued to the unofficial respondents as well as the petitioners, and after examining the records and taking into consideration of the contentions so to be raised by petitioners and unofficial respondents, he shall take decision and pass appropriate orders by assigning reasons. This entire exercise shall be completed within twelve (12) weeks from the date of communication of this order. Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
