HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.41053 OF 2014 ORDER:

The petitioner complains against the inaction of respondents 2 to 6 in considering the representation dated 03.11.2014, as illegal and arbitrary.

The petitioner through her counsel sent the representation/ notice dated 03.11.2014 to the respondents herein. The complaint of petitioner is that in respect of the schedule property covered by the representation/notice dated 03.11.2014, the petitioner asserted her claim for apportionment of compensation payable by the respondents in the pending land acquisition proceedings. At the time of hearing, the learned Assistant Government Pleader representing the respondents, submits that the enquiry under Section 5 of the Land Acquisition Act is pending and the representation/notice dated 03.11.2014 will be considered by the authorities. The writ petition is disposed of directing the respondents to consider the representation/notice dated 03.11.2014 in accordance with law, if necessary, provide opportunity to the petitioner before hand and pass appropriate orders.
