SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1511 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is A-10 in Crime No.280 of 2015 on the file of the Station House Officer, Manchal P.S., Rachakonda District. The offences alleged are under Sections 406, 420, 468 and 471 read with Section 120-B of the Indian Penal Code.

Heard the learned counsel for the petitioner/A-10, learned Public Prosecutor appearing for the respondent-State, and perused the record.

Counsel for the petitioner submits that this petitioner is not a person who obtained loan from the bank.

Learned Public Prosecutor submits that the loans were granted to the farmers at the instance of this petitioner, who gave fake passbooks to the farmers. Hence, it cannot be said that this petitioner is not instrumental for obtaining loans, by submitting fake passbooks. Learned Public Prosecutor further submits that the other accused were denied anticipatory bail. The nature of the allegations does not entitle the petitioner for grant of anticipatory bail.

Considering the facts and circumstances and nature of allegations, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the

bail application of the petitioner on merits and in accordance with law, on the same day subject to the regular pressure of work. With the above observation, this Criminal Petition is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed.
