THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE NO.2616 OF 2016 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. challenging the order, dated 26-09-2016 in Crl.M.P.No.648 of 2016 in STC.No.19 of 2013 on the file of the Special Magistrate, Palamaner.

When the matter is taken up for hearing, Mr.V.Surendra Reddy, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the Criminal Revision Case with a liberty to appear before the trial Court. He further submitted that the trial Court may be directed to dispose of the petition, if any, filed by the petitioner under Section 70 (2) Cr.P.C. on the same day. Permission is accorded.

Accordingly, the Criminal Revision Case is dismissed as withdrawn. The trial Court is hereby directed to dispose of the petition, if any, filed by the petitioner under Section 70 (2) Cr.P.C. on the same day taking into consideration the health condition of the petitioner and other attending circumstances without being influenced by the orders passed in Crl.M.P.No.648 of 2016.
