Heard.

The petitioner is the owner of vehicle bearing No.AP-20-TB-1406 and it was seized while transporting 45 bags of rice equivalent to 22.50 quintals and 6-A proceedings were initiated in respect of the seized stock and the vehicle. The petitioner has submitted a representation to the 2nd respondent on 19-06-2015 for release of the vehicle pending disposal of 6-A proceedings, but no orders have been passed by the 2nd respondent. Challenging inaction of the 2nd respondent, the present writ petition is filed. It is submitted by the learned counsel for the petitioner that the vehicle is required by the petitioner for her day-to-day activities and if the vehicle is kept in the custody, there will be damage to the vehicle. Learned counsel for the petitioner offers an amount of Rs.40,000/- as security for release of the vehicle. But the same is disputed and the learned Government Pleader requires the security of Rs.1,50,000/- for release of the vehicle.

In the circumstances, this writ petition is disposed of directing the 2nd respondent to release the vehicle belonging to the petitioner bearing No.AP20-TB-1406 seized on 18-04-2015 and in respect of which 6-A proceedings are pending before him, subject to the condition that the petitioner shall furnish bank guarantee of Rs.1,50,000/- (Rupees one lakh fifty thousand only) within a period of one week from the date of receipt of a copy of this order with an undertaking of producing vehicle as and when required by the 2nd respondent and not alienating the same during pendency of 6-A proceedings. No order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
