HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.39190 of 2016 ORDER:
Heard learned counsel for the petitioner and also Sri R.Vinod Reddy, learned Standing Counsel representing respondents, saying he got oral instructions in offering to file vakalath and perused the prayer in the writ petition with the supporting affidavit and other material on record. It is the submission of the learned Standing Counsel that there is a remedy of appeal. Had it been maintained the appeal, they are bound to pay or deposit 50% of the demand amount assessed to maintain the appeal.
Having regard to the above and in the result, the Writ Petition is disposed of by giving liberty to the petitioner to pay 50% of the demand amount assessed for restoration of the power supply by collecting other usual charges and in the event of filing of appeal within one week from the date of receipt of a copy of this order, the appellate authority shall without insisting for any limitation period entertain the appeal and decide on own merits. Any further grievance of the petitioner is left open. Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
