HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29239 OF 2015 ORDER:

The grievance of the petitioners is that they are the absolute owners and possessors of the agricultural land to the extent of Ac.0.28 guntas, out of Sy.No.109/A/2 of Goreekunta Revenue Village, Gessugonda Mandal, Warangal District, which is situated at Gandhi Nagar and within the limits of Warangal Municipal Corporation. While so, the 2nd respondent encroached the land of the petitioners and also applied for building permission. Though the petitioners have issued legal notice dated 12.08.2015, objecting for permission, the respondents have not passed any orders on the same. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioners and Smt.Pingali Lakshmi, learned Standing Counsel for respondent Corporation. It is brought to my notice that when the 2nd respondent filed WP.No.

22176 of 2015 this Court disposed of the writ petition directing the respondent Corporation to consider the application submitted by the petitioners on 24.06.2015 for grant of building permission as well as the explanation submitted by the petitioner on 20.06.2015 against the show cause notice dated 16.06.2015 and pass appropriate orders as warranted by law, if necessary, by affording opportunity of personal hearing.

Smt.Pingali Laxmi, learned Standing Counsel for respondent Corporation states that as on today no building permission is granted to the 2nd respondent.

In view of the above facts and circumstances, the respondents are directed to take into consideration the objections raised by the petitioners on 12.08.2015, while granting building permission to the 2nd respondent as directed by this Court in the earlier writ petition No.22176 of 2015.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending in the writ petition shall stand closed.
