THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.19055 of 2004 ORDER:
1 This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in not fixing the time scales while fixing same to the similarly situated persons as being arbitrary, illegal, discriminatory and contrary to the circular No. 7933/APSC/86, dated 18.02.1987 and 19.03.1987 issued by the first respondent and consequentially to direct the respondents to fix the time scales in accordance with the circulars issued by the first respondent corporation and to pay all the consequential benefits, which are entitled to the petitioner.
2 When the matter is taken up for hearing, the learned counsel for the petitioner submitted that he has no instructions from the petitioner. It seems that the petitioner is not interested in prosecuting the matter. No purpose will be served by keeping the matter pending. The learned standing counsel for the respondent is present. 3 Hence the Writ Petition is dismissed. No costs. As a sequel, miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
