Sri Srinivasa Nagar Colony Welfare Association v. The State Of Telangana
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.5249 of 2019
ORDER
This writ petition is filed seeking to declare the action of respondents 2 to 6 in not taking action against the illegal construction made by the 7th respondent in the land of the petitioner Association, as illegal and arbitrary.
2.
The petitioner Association had purchased lands in Sy.Nos.142 and 143 situated at Kuntloor Village for the benefit of its members and the respective members had executed the sale deeds. It is asserted that the 7th respondent is trying to encroach upon their land by making illegal constructions.
In those circumstances, the petitioner made a representation to the 6th respondent on 05.10.2018 complaining about the highhanded action of the 7th respondent. But no action has been taken thereon. 3.
Learned counsel appearing for the 6th respondent, Sri V. Narsimha Goud, submits that as the dispute is between the private parties, there is no duty cast upon the 6th respondent to act upon the representation of the petitioner.
4.
Having regard to the respective submissions, this Court is not inclined to decide the dispute regarding the alleged encroachment/trespass into the land of the petitioner by the 7th respondent. However, the petitioner is at liberty to approach the competent civil Court in accordance with law.
CKR, J W.P.No.5249 of 2019
5. Hence, the Writ Petition is closed. No order as to costs. 6.
Miscellaneous application, if any pending in this writ petition, shall stand closed.
