HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3996 OF 2017 ORDER:
The present petition is filed under Section 438 of the Code of Criminal Procedure, 1973, by the petitioner for grant of anticipatory bail in the event of her arrest in Crime No.184 of 2016 of Vinukonda Town Police Station, Guntur District.

The petitioner is arraigned as accused No.2 and she alleged to have committed the offence punishable under Section 304-B read with 34 IPC.

Heard Miss V.Baby Rani, learned counsel for the petitioner and learned Additional Public Prosecutor for the State of Andhra Pradesh. 4.
Learned counsel for the petitioner would submit that from the date of marriage, the petitioner, who is the mother-in-law of the deceased, was residing separately but not with the deceased and her husband, the 1st accused. Her submission is that at the time of the death of the deceased, the petitioner was at Hyderabad, where she undergoing treatment. She further submitted that the petitioner is suffering with heart disease and paralysis and neuro, therefore, urges to grant anticipatory bail.

Learned Additional Public Prosecutor while resisting the request stated that earlier this Court in Crl.P.No.2713 of 2017 dismissed the anticipatory bail filed by the petitioner and there are no changed circumstances and, therefore, sought for dismissal of the present petition.

Perused the order passed by this Court in Crl.P.No.2713 of 2017, dated 07.04.2017. This Court, considering the submissions made in Crl.P.No.2713 of 2017 and dealing with the statements elaborately, dismissed the petition on the ground that no documentary proof was filed to show that the petitioner is suffering with heart problem except a slip issued by Balaji Diagnostics with regard to examination of blood and urine, etc., Even in the present petition also no medical proof is forthcoming to show that the petitioner is suffering with paralysis or any other disease. Thus, no changed circumstances are to be found to grant anticipatory bail. 7.
Accordingly, the criminal petition is dismissed. 8.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
