THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8704 of 2016 ORDER:
This Criminal Petition is filed by the petitioner - A.3, under Section 482 Cr.P.C., to quash the proceedings in C.C.No.41 of 2015 on the file of Judicial Magistrate of First Class, Nandyal. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor representing the State. Having perused the material on record, it is evident that it is not a fit case to quash the proceedings in C.C. However, on the submissions of the learned counsel for the petitioner, this Court feels it appropriate to direct the Court below to dispose of the C.C. itself as expeditiously as possible.
In that view of the matter, the Criminal Petition is disposed of directing the learned Judicial Magistrate of First Class, Nandyal, to dispose of C.C.No.41 of 2015, within a period of six (6) months from today, without insisting the presence of petitioner - A.3 on each and every adjournment, unless the learned Magistrate feels that his presence is necessary for any specific purpose. Pending miscellaneous applications, if any, shall stand closed in consequence.
