HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.1358 OF 2022 ORDER:

This Criminal Petition is filed to quash the proceedings against the petitioners/Accused 3 & 4 in S.C.No.244 of 2021 on the file of Special Court for the Trial of SC/ST (POA) Act-cum-VII Additional District and Sessions Judge, Ranga Reddy District at L.BNagar. 2.

The 2nd and 3rd respondents lodged a complaint stating that they are associated with A1 and A2 and these petitioners, who are from Q News and worked as State Coordinator and Social Media incharge. After MLC elections, the 1st phase committees were formed and at the time of forming 2nd phase committees, the complainants were not given chance and were humiliated by these petitioners in the name of caste. When the said issue was informed to A1, A1 stated that he would look into the issue. However, according to the complainants, even A1 and another abused the complainants in the name of caste.

Aggrieved by such abuses, complainants lodged criminal complaint, which was investigated by the police and charge sheet was filed.

Learned counsel appearing for the petitioners would submit that none of the ingredients of any of the penal provisions are made out against these petitioners. There is no specific mention of any utterances made by these petitioners. The allegations are leveled against other accused and only for the reason of the 1st petitioner being related to A1 as brother and also the 2nd petitioner, these petitioners were falsely implicated in the complaint. 5.

A reading of the complaint would reveal that it is specifically mentioned that these petitioners had also abused in the name of caste. Whether the incident was within the public view or not or whether the petitioners were falsely implicated are all questions of facts which can only be decided during the course of trial. 6.

In the result, the Criminal Petition is liable to be dismissed and accordingly, dismissed. Consequently, miscellaneous petitions, if any, shall stand disposed.
