THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No. 7831 of 2015 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) In terms of our interim order dated 24.3.2015, the respondentMunicipal Corporation has removed the seal and lock of the shop of the petitioner. The petitioner shall make a representation within seven days from the date of receipt of a copy of this order to the Municipal Corporation in relation to the issues involved in the writ petition. On receipt of the same, the Municipal Corporation will give a personal hearing to the petitioner and pass a speaking order and thereafter assess the tax payable by the petitioner. If no representation is made in terms of this order, the issue will be a closed chapter and in that case, the Municipal Corporation will be free to take steps in accordance with law. After the decision is rendered, both the parties will be free to take steps.
The writ petition is accordingly disposed of. Pending miscellaneous applications shall also stand closed. No costs.
