SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1533 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused in Crime No.73 of 2017 on the file of the Station House Officer, Mudivedu Police Station, Chittoor District. The offences alleged are under Sections 120-B and 302 read with Section 34 of the Indian Penal Code.
Heard the learned counsel for the petitioner/accused, learned Public Prosecutor appearing for the respondentState, and perused the record. Learned Public Prosecutor brings to the notice of this Court the earlier order dated 19.01.2018 in Criminal Petition No.24703 of 2017, which was filed for grant of anticipatory bail to the petitioner.
This Court observed that the petition cannot be allowed, as the facts of the case do not warrant grant of anticipatory bail to the petitioner and granted liberty to the petitioner to surrender before the lower Court having jurisdiction and obtain regular bail. On filing of such application, the concerned Court is directed to dispose of the same, on merits and in accordance with law, as expeditiously as possible, preferably on the same day, subject to pressure of other work.
In the light of the above, this bail petition cannot be entertained.
Hence, the Criminal Petition is dismissed.
Miscellaneous petitions, if any, pending shall stand dismissed.
