THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.5214 OF 2019 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home appearing for respondents 1 to 4. 2.

Petitioner alleges that though a cognizable offence was reported on 07.08.2017 in Miyapur Police Station, crime was not registered and such action is ex facie illegal and arbitrary. 3.

Learned Government Pleader for Home, on instructions, informs the Court that no such complaint was filed in Miyapur Police Station, as alleged, and therefore no action was taken by the respondent - police.

Admittedly, no proof of complaint is enclosed to the Writ Petition paper book.

At this stage, learned counsel for the petitioner seeks leave of the Court to lodge a fresh complaint.

There is no bar in filing a complaint. It is always open to an aggrieved person to lodge a complaint about commissioning of an offence.

7.

Thus, leaving it open to the petitioner to file a fresh complaint, if so advised, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
