THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1315 OF 2016 ORDER:

This Criminal Revision Case is filed by the petitioner-accused No.1, under Sections 397 and 401 of the Code of Criminal Procedure, seeking to set aside order, dated 02.05.2016, passed in Crl.M.P. No.492 of 2016 in PRC No.20 of 2014, by the XXV Metropolitan Magistrate, Cyberabad, at Kukatpally and consequently grant permission for renewal of passport of the petitioner and also for traveling abroad, during the pendency of criminal proceedings.

Heard and perused the material available on record. The case in brief is that the petitioner - A1 and other two accused were charged for the offence punishable under Section 306 IPC and the same was numbered as PRC No.20 of 2014. This Court granted interim stay of further proceedings in PRC No.20 of 2014 and the stay is subsisting. The petitioner filed the impugned application before the Court below seeking permission for renewal of his passport and also for traveling abroad. The Court below dismissed the said application through the order impugned. Against the said order, the present revision case is filed.

Learned counsel for the petitioner submits that petitioner's passport is going to be expired in the month of October, 2016 and therefore, he has to renew his passport and that he has to visit USA in June, 2016 to attend a conference, since he is working as a Senior Director for integration teams in a Software Company. Considering the submissions of the learned counsel for the petitioner, this Court is inclined to pass the following order: "The petitioner is permitted to file an application before the passport authorities concerned for renewal of his passport and on such application being filed, the passport authorities concerned, shall renew

the same, in accordance with law. The petitioner is permitted to leave abroad, after filing an affidavit before the Court below informing the date on which he is leaving India and also the date on which he is returning." Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J June 08, 2016.
