THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.18554 of 2007 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

" For the reasons stated in the accompanying affidavit that this Hon'ble Court may be pleased to issue writ or direction particularly in the nature of mandamus or any other appropriate writ, directing the respondents to consider the case of the petitioner to transfer to any branch of the respondent bank at Vijayawada and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." (Reproduced verbatim) 2.

I have heard the submissions of the learned counsel for the petitioner and of the learned Standing Counsel appearing for the Bank, representing the respondents 1 and 2. I have perused the material record. 3.

Learned counsel for the petitioner would submit that the relief claimed relates to the request of the petitioner to transfer her to any branch of the respondent Bank at Vijayawada and that in view of the passage of time, the said relief has become infructuous; he, therefore, would further submit that the writ petition may be disposed of reserving liberty to the petitioner to submit a representation to the respondents for appropriate consideration of her case.

Learned Standing Counsel for the Bank, on instructions, would submit that the petitioner is not attending the Bank with effect from 28.02.2007. 5.

Recording the said submissions, the Writ Petition is dismissed as infructuous, however, reserving liberty to the petitioner to submit a representation, within four weeks from the date of receipt of a copy of this order, to the authorities concerned of the Bank for appropriate consideration

It is needless to mention that in case the petitioner submits any such representation, the authorities concerned shall consider and dispose of the same in strict accordance with law, however, as expeditiously as possible, and preferably within two months from the date of submission of such representation.

Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
