THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.29081 of 2012 ORDER:

The petitioners pray for the following relief :- " ..... to issue a writ, order or direction more particularly one in the nature of writ of mandamus by declaring the in action of the official respondents in taking any steps to stop the illegal construction by the 5th respondent in Sy.No.962/ A situated at Nangnoor Village and Mandal Medak District by encroaching the into the Grampanchayath road and into the open land of the 4th Respondent as well, in pursuant to the representation made by the petitioners dated 09.05.2012, as illegal, unjust, arbitrary, without application of mind, ultra vires the provisions of A.P.Panchayath Raj Act, 1994, and consequently direct the official Respondents to stop the illegal construction by the 5th respondent in Sy.No.

962/ A situated at Nangnoor Village and Mandal, Medak District, by encroaching into the Grampanchayath road and into the open land of the 4th Respondent as well ...." Sri Ramachandra Reddy representing respondents 3 and 4, on instructions, submits that there is a boundary dispute between petitioners and 5th respondent and the boundaries are to be localized in accordance with law by the Mandal Revenue Officer and if the survey is conducted, the 3rd respondent is prepared to take action, if circumstances warrant, in accordance with law. The statement is placed on record.

The counsel for petitioners seeks liberty to approach the Mandal Revenue Officer for survey and on receipt of survey report,

the petitioners will approach the 3rd respondent for appropriate action.

Accordingly, the writ petition is disposed of by granting liberty as prayed for. No order as to costs.
