29.12.2021 LK,J I.A.No.1 of 2021 This application is filed by petitioner/A.2 to relax condition No.(ii) i.e., on such release, the petitioner/A.2 shall appear before the Investigating Officer on 3rd Saturday of every month between 10.00 AM and 2.00 PM, till completion of investigation or filing of the charge sheet whichever is earlier, imposed in Crl.P.No.2039 of 2021, by order dated 22.03.2021.

Learned counsel for the petitioner submits that the petitioner has been complying with the said condition from the date of the order and investigation is almost completed. Hence, the said condition may be relaxed.

Learned Assistant Public Prosecutor submits that the petitioner is appearing before the police as directed by this Court. However, the investigation is still pending. Taking into consideration the petitioner is complying with order passed by this Court on 22.03.2021 in Crl.P.No.2039 of 2021, condition No.(ii) is hereby modified to the extent of "Till filing of the charge sheet, the petitioner shall appear before the Investigating Officer as and when his presence is required. Further, respondent police shall give an advance notice to the petitioner in this regard". Accordingly, this application is ordered.
