THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23117 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue a writ of Mandamus to declare the demand notice, dated 02.06.2017, issued by the respondent - Greater Visakhapatnam Municipal Corporation without issuing special notice and calling for objections of the petitioner as illegal, arbitrary and contrary to the provisions of the Hyderabad Municipal Corporation Act, 1955 and consequently, to set aside the same.

The petitioner mainly challenges the demand notice, dated 02.06.2017, issued by the respondent Corporation against his house property bearing D.No.10-2-9/ 3, Mehar Nagar, Old Gajuwaka, Visakhapatnam District and the penalty imposed therein. Heard and perused the material available on record. Considering the facts and circumstances of the case, the petitioner is hereby directed to pay 50% of the total demanded amount including the penalty on or before 10.09.2017 and after making such a payment, the petitioner shall make a representation before the authorities concerned by enclosing the receipt and on such representation being made, the authorities shall consider the same and pass appropriate orders in accordance with law after hearing both sides. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
